What is USCIS?
United States Citizenship and Immigration Services. They are a federal government agency that oversees lawful immigration matters and authorized OPT work authorizations.
Am I eligible to apply for OPT?
To be eligible for OPT you must:
- Maintain F-1 visa status at the time of application
- Must be completing all course requirements in the final semester
- Must be enrolled in full-time for at least one academic year
- Must be physically in the U.S. when you submit your OPT application
- Only one OPT may be used at each degree level
- One year of full-time CPT will cancel your OPT eligibility
Do I have to have a job offer to apply for OPT?
No, you do not need a job offer to apply for OPT.
Do I need a valid F-1 visa to apply for OPT?
No, students with expired or expiring F-1 visas can apply for OPT.
How can my past CPT experience affect my Post-Completion OPT?
One year of full-time CPT will affect your eligibility to apply for OPT.
What is the application deadline for OPT?
USCIS must receive your OPT application as early as 90 days before your program completion date and no later than 60 days after your program completion date.
What is an OPT I-20?
An OPT I-20 is different from your current I-20. An OPT I-20 shows your OPT recommendation on page 2, under the Employment Authorizations section.
In order to receive an OPT I-20, you must attend the OPT workshop and submit a completed OPT Request Form to iss@chapman.edu.
How do I choose a start date for my OPT?
- The OPT start date must be within the 60-day grace period.
- When choosing the start date, choose the earliest date you might want to start working.
- Keep in mind - this is a requested OPT start date. The official OPT start date will be on your EAD card. You cannot work until you receive your EAD card.
Can I travel out of the U.S. while my I-765/OPT application is pending with USCIS?
It is highly recommended not to travel while your OPT application is pending. The best option is to wait until you receive your EAD card before you travel. If you need to discuss your situation, please contact ISS for assistance.
Can I stay in the U.S. once my 60-day grace period ends if my I-765/OPT application is still pending?
If you received an I-797 receipt notice in the mail and your OPT application is still pending with USCIS, you are allowed to stay in the U.S. after your 60-day grace period.
How long is the processing time for applications?
Can I work while waiting for my EAD?
Once you complete your degree, you cannot work on or off campus. You must wait for the USCIS approval notice and EAD to begin employment.
